I. General Terms and Conditions 1. The online store available at the Internet address thaim.pl/store is operated by Mythaispa Sp.
z o.
o.
Sp.
limited partnership with its registered office in Warsaw, ul.
Ketlinga 30, 03-289 Warsaw; entered in the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000739402, NIP 5242776793, REGON 360743535 and e-mail address: kontakt@thaim.pl.
(2) The administrator of personal data processed in the Online Store is the Seller.
Detailed provisions on the processing and storage of personal data, as well as the purpose of their collection are placed in the Privacy Policy document.
This document also contains information on the use of cookies and other analytical tools in the store.
3 Definitions appearing in the Regulations:
1. customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;
2. the Civil Code – the Civil Code Act of April 23, 1964.
(Journal of Laws 1964 No. 16, item 93 as amended);
3. Terms and Conditions – these Regulations for the provision of electronic services within the online store sklep.tajskiespa.pl;
4. online Store (Store) – the Service Provider’s online store available at the following Internet address: thaim.pl/shop, through which the Customer may, in particular, place Orders;
5. Product – a movable item available in the Online Store which is the subject of a Sales Contract between the Client and the Seller;
6. contract of sale – a contract of sale of Goods within the meaning of the Civil Code, concluded between the operator of the thaim.pl/shop and the Customer, concluded using the online tool of the Shop;
7. the Consumer Rights Act – the Act of May 30, 2014.
On consumer rights (Journal of Laws 2014 item 827 as amended);
8. Business Day – one day from Monday to Friday excluding public holidays.
9. Order – the Customer’s statement of intent, submitted via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.
10. Electronic Services Act – the Act of July 18, 2002.
on provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended);
4. making purchases in the Online Store sklep.tajskiespa.pl means acceptance of these Terms and Conditions.  

II. Procedure for placing and processing orders (1) It is not necessary to create a user account in order to properly carry out the Order procedure, and the purchase process is possible after reading and accepting these Regulations.
In the case of registration, the condition of registration is acceptance of these Regulations and providing all necessary data, marked as mandatory.
An order can be placed by using the function of adding a product to the shopping cart.
(2) The basic condition for the realization of purchases made is the correct completion of contact details, including a valid, existing e-mail address and telephone number at which it will be possible, if necessary, to confirm the order.
The Client is obliged to use the Online Shop in a manner consistent with the law and morality, taking into account respect for personal rights and copyrights and intellectual property of the Service Provider and third parties.
The Customer is obliged to enter data in accordance with the facts.
(3) The order can be placed 24 hours a day throughout the year.
(4) In the event of circumstances that make it completely or temporarily impossible to carry out the order placed, the company reserves the right to suspend the execution of the order – about the situation it undertakes to immediately notify the Client.
(5) Orders in which contact details are incorrectly filled (non-existent e-mail or lack of telephone number) preventing any contact with the purchaser will not be implemented.
(6) The company reserves the right to suspend orders that raise doubts.
(7) The prices of goods in the online store thaim.pl/shop are given in Polish zloty and represent the final purchase amount for the Buyer.
8 The company Mythaispa sp. z o.o. sp. limited partnership is a VAT payer and issues invoices for the purchased goods.
(9) The Seller provides the Customer with the following methods of payment for the execution of the Order:
a) Payment by bank transfer to the Seller’s bank account.
b) Electronic payment and payment by credit card through the operator eService Sp.
z o.o. The operator supports payment cards: * Visa * Visa Electron * MasterCard * MasterCard Electronic * Maestro.  

III.
Delivery
(1) Delivery of the Goods shall be limited to the countries of the European Union and shall be made to the address indicated by the Customer when placing the Order.
(2) Delivery of the ordered Goods is carried out via: – Courier company – Parcel machines – Polish Post Office
(3) The delivery time is a maximum of 2 working days from sending the package.
4) It is not possible to collect the ordered goods in person in our store.  

IV.
Complaints and returns
1.Mythaispa sp. z o.o. sp. kom., as a seller, is liable to the customer who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Article 556[1]-556[3] of the Civil Code.There is the possibility of personal collection of the ordered goods in our store. (2) Complaints arising from defects in the purchased product should be sent by e-mail to the box: kontakt@thaim.pl, or in writing to the address of Mythaispa sp. z o.o. sp. komandytowa, 30 Ketlinga Street, 03-289 Warsaw. (3) The Seller shall respond to the Customer’s complaint immediately, no later than within 14 calendar days from the date of its submission. If the Customer, who is a consumer, has requested replacement of the item or removal of the defect, or has made a statement on price reduction, specifying the amount by which the price is to be reduced, and the Seller has not responded to this request within 14 calendar days, it shall be considered that the request was justified. (4) The customer who exercises warranty rights is obliged to deliver the defective product to the address: 30 Ketlinga Street, 03-289 Warsaw. In the case of a Customer who is a consumer, the cost of delivery of the Product shall be borne by the Seller, in the case of a Customer who is not a consumer, the cost of delivery shall be borne by the Customer. (5) The Buyer may withdraw from the contract without giving any reason within 14 days from the date of receipt of the goods. (6) Goods damaged by the Buyer or bearing signs of use shall not be returned. (7) In the case of return of a full-value product by the Buyer, the Seller has 14 days to refund the money. 8. the Seller shall refund the payment using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not incur any costs for him.
V Personal Data 1. The Service collects information provided voluntarily by the user.
2. personal data is obtained when filling out the registration form in the online store.
(3) Personal information is used only for the purpose of finalizing transactions and sending newsletters if the User has given his consent.
(5) The content of the website can be viewed without providing any personal information.
(6) Any person who has provided his/her personal data has the right to access their content and the possibility to correct, update, complete them, as well as to request to stop processing personal data and to object to the processing of personal data.
The aforementioned actions can be performed by sending an appropriate statement to the following email address: klinika@tsclinic.pl.
7 Personal data acquired by the administrator shall be stored, processed and protected in accordance with applicable laws, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.
on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) – hereinafter referred to as “RODO”.
The collection of personal data has been reported to the General Inspector of Personal Data.

The Administrator protects the collected personal data using the following measures: – encryption of data used to sign up for the newsletter – securing the dataset against unauthorized access

VI.
Rules of Sale of Gift Cards

 

  • Gift Cards are issued in the form of an invitation packaged in an envelope.
  • Gift Cards are available for sale at all times and can be for any amount and any treatment from the Thaim by Thai Spa offerings.
  • The amount cards are in the form of a named invitation.
    You can also purchase unnamed invitations for selected services or service packages.
  • Cards can be purchased and redeemed at any Thaim by Thai Spa salon.
    Purchase of Cards at the salons does not involve any additional fees
  • Cards can also be purchased by placing an order through the order form available at thaim.co.uk/store
  • When paying by bank transfer, reservations under the Card can be made only after the money is credited to our account.
  • At the Buyer’s request, the Gift Card can be shipped to the specified address.

 

VII.
Regulations for the use of Gift Cards

 

  • Gift Cards entitle you to receive services at all Thaim by Thai Spa salons.
  • Cards are valid for a period of 6 months from the date of purchase (does not apply to temporary promotions that change the validity period of the cards) – during this period you must use the purchased treatments.
    After the expiration of the validity period, the Cards lose their validity.
    There is a possibility to extend the validity period of Gift Cards by 3 months counted from the date of their expiration.
    The extension costs 50% of the value of the treatment at the regular price.
  • The card can be used for one or more visits, depending on the service purchased.
    The card for a single longer massage (e.g., 1.5 or 2h) cannot be split over several visits.
  • To arrange a convenient appointment, please contact the reception desk at tel.
    799-111-997 or by calling the landline numbers of the specific salon.
  • If there is no cancellation by phone or in person 3h before the appointment, the Gift Card will be considered redeemed.
  • The card must be presented at the reception desk before receiving the treatment.
  • The Card is not refundable or exchangeable for cash.
    There is, also, no possibility of giving change in cash from Cards that amount to more than the value of the services performed.
  • A person using the Gift Card can pay extra to the Card and choose a more expensive service (a different treatment or extended treatment time).
  • Payment by Card cannot be combined with other promotions and discounts.
  • Registered cards can be transferred to other persons.
  • In the event of loss or destruction of the Gift Card, Thaim by Thai Spa shall not be liable or compensate for the loss caused by the situation.
  • An integral part of the Gift Cards is these Terms and Conditions, which are made available at the reception of Thaim by Thai Spa salons upon request.
    When placing an order, the Buyer declares that he or she has read and accepts these Terms and Conditions in their entirety.
  • Gift cards cannot be used on the day of purchase.
